Yenos Analytical LLC ("Yenos") a California registered company, is offering its services to conduct the Yenos cancer urine test ("Yenos test"), only to those who agree to the following terms and conditions (hereinafter "Services").

By accessing or using this service, you expressly agree to be bound and abide by these Services. Please read them carefully.

Requirements for Use of the Services

By using the Services, you represent and warrant to us that you are (i) of legal age to form a binding contract with Yenos, (ii) agree to these Services, and (iii) are not barred under any applicable laws from doing so. You must be 18 years or older to submit a urine sample. The product is intended for ages 30-80, not recommended for individuals under 30, pregnant individuals or those receiving active cancer treatment.

2. Description of Services

The Services currently include (i) analysis of the levels of certain biomarkers in the urine sample you provide, and (ii) based on our own clinical studies a Results Report to assess whether the cancer biomarkers determined in your urine sample are comparable to healthy people or people who have been diagnosed with Stage I/II cancer indications, such as lung, prostate, pancreatic, breast, ovarian and colorectal.

3. Changes to these Services

At our sole discretion, we may revise and update these Services and post the updated Services on our website www.YenosAnalytical.com. All changes are effective immediately upon posting to our website and will apply to all access to and use of the Services from that point onward. Your continued use of the Services after posting means that you acknowledge and agree to the revised Services. We reserve the right to withdraw or amend the Services or any portion thereof in our sole discretion at any time without notice.

4. Ordering our Test

To access the Yenos test you must complete a registration. The only information we are collecting is your name and address so that we can FedEx you the Yenos kit. The Yenos test is the only test shown to be independent of sex, age, and ethnicity, and therefore we don’t request such information. You also agree that all information you provide to us, no matter how you do so, is governed by our Privacy Policy. You consent to us using your information in ways that are consistent with that policy. You authorize Yenos to authenticate your identity when accessing the Services. If we believe that you have violated these Services, we have the right at any time to disable or terminate your access.

5. Processing the Test

A urine sample is required and must be shipped to our laboratory no more than 30 days after you receive the Yenos kit. Your urine sample must be returned in the specimen collection kit according to the requirements in our instructions. Failure to ship your specimen in the manner described in the shipping instructions may result in a rejection of your specimen.

By submitting your urine sample to our laboratory, you agree to the following:

  • You are submitting your own urine sample or a sample for someone for whom you are legally authorized to act.
  • You are 18 years of age or older, or you are submitting a sample for a person who is 18 years of age or older for whom you are legally authorized to act.
  • You allow Yenos to perform analysis on the sample you submit.
  • Yenos does not submit or process insurance claim paperwork or claims for the Services. The Yenos cancer test is not covered under any coverage policy by insurance plans at this time. We do not expect the Services to be paid for by any health insurance policy and cannot guarantee that the fees charged for any Services will be reimbursed by any insurance provider.

6. Interpreting Test Results

You understand that the health-related interpretations provided by Yenos are for informational purposes only and are not intended to definitively diagnose or treat any disease or condition.

You further understand that Yenos cannot offer individualized medical advice to you beyond what is provided in our Results Report. You acknowledge that Yenos does not warrant the accuracy, completeness, timeliness, or usefulness of the content, quality, interpretations, or recommendations of our Results Report.

7. Participation in ongoing research and development

We formally request that you inform us when you receive a result, different from the one shown in your Results Report, from any of the current recommended cancer screening tests. This will support the on-going process of developing accurate cancer screening tests.

8. Communications

Consistent with our Privacy Policy (see below) you agree to receive communications from us in connection with your test. You agree that all digital agreements, notices, disclosures, and other communications that we provide to you meet any legal requirement that such communications be in writing.

9. Intellectual Property Rights

The Yenos cancer test (including but not limited to all information, software, algorithms, database, proprietary techniques, and patentable subject matter) are owned by Yenos and its licensors and are protected by the United States and international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws. To the extent that your data, in combination with data from many other individuals similarly tested, contributes to new intellectual property, ownership thereof shall remain with Yenos and may be sold or licensed to third parties, as long as your personal identity is maintained anonymous, without remuneration to you.

10. Geographic Restrictions

Yenos is a United States company that provides Services to persons over the age of 18 in the United States. We make no claims that the Services or any of its content are accessible or appropriate outside of the United States.

11. Notice of Technical Limitations

Cancer can arise from various changes to otherwise normal cells in the body. Like every test, false positive and false negative results are plausible. The Yenos test is NOT a definitive test for cancer. The only definitive test for any cancer is an analysis of biopsied tissue by a qualified pathologist.

The Yenos cancer test is a laboratory developed test (LDT) and is not currently regulated by the U.S. Food & Drug Administration (FDA). Only laboratories carrying the Yenos name are qualified to conduct this test. The quality control standards we follow are proprietary and set by us. Despite our focus on quality, problems with our sample process may occur from time to time. These problems may result from sample misidentification, a contaminated sample, or insufficient urine. We continuously perform quality control on our processes and procedures. Even so, errors may result during data generation in the lab and in the processing of the data on servers.

The Yenos cancer test should supplement, but never replace, routine cancer screening tests recommended by your healthcare professional and/or leading national medical organizations such as the American Cancer Society and various medical specialty organizations that publish practice guidelines.

Our Services do not incorporate a complete view of your health history. Before you act on any health information provided through the Results Report please first consult with your healthcare professional.

12. Disclaimer of Warranties

Yenos makes its best efforts to offer technical analysis and reports of high quality. However, we do not warrant the accuracy or usefulness of our product, technology, or the results report. Yenos and all parties associated with Yenos hereby disclaim all warranties of any kind, either express or implied, statutory or otherwise, including but not limited to any warranties of merchantability, non-infringement, and fitness for particular purpose.

13. Limitation of Liability

In no event will Yenos, Yenos affiliates or their licensors, service providers, employees, agents, officers, or directors be liable for damages of any kind, under any legal theory, arising out of or in connection with your use, or inability to use, the services, or any content on our website or such other websites, including any direct, indirect, special, incidental, consequential or punitive damages, including but not limited to, personal injury, pain and suffering, emotional distress, loss of revenue, loss of profits, loss of business or anticipated savings, loss of use, loss of goodwill, loss of data, and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable.

14. Indemnification

You agree to defend, indemnify, and hold harmless Yenos, its affiliates and licensors and their respective officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses or fees (including reasonable attorneys’ fees) resulting from your violation of these Terms of Service or your use of the Services, including, without limitation, any use of the content, services, and products of the Services other than as expressly authorized in these Terms of Service or your use of any information obtained from the Site.

15. Dispute Resolution

If a dispute arises between you and Yenos, you agree to first contact Yenos’ Customer Support info@yenosanalytical.com to seek a resolution. If our Customer Support is not able to resolve the issue, then except for disputes relating to the infringement or other misuse of intellectual property rights. Such disputes will be resolved through binding arbitration rather than in court.

16. Waiver and Severability

No waiver of these Services by Yenos shall be deemed a further or continuing waiver of such term or condition or any other term or condition. Any failure of Yenos to assert a right or provision under these Services shall not constitute a waiver of such right or provision. If any provision of these Services is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of these Services will continue in full force and effect.

17. Entire Agreement

These Services, and our Privacy Policy (see below) constitute the sole and entire agreement between you and Yenos with respect to the Services and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to the Services.

18. Miscellaneous

These Services and any dispute or claim arising out of, or related to, them, their subject matter, or their formation (in each case, including non-contractual disputes or claims) will be governed by and construed in accordance with California law, without regard to its conflicts of laws principles and excluding the applicability of United Nations Convention for the International Sale of Goods. To the extent that any lawsuit or court proceeding is permitted hereunder, you and Yenos agree to exclusively litigate such disputes in the state courts located in El Dorado County in California, and both parties’ consent to venue and personal jurisdiction in California.

You may not assign any of your rights in these Services, and any such attempt is void. Yenos may assign its rights to any of its affiliates or subsidiaries, or to any successor in the interest of any business associated with the Services. Yenos and you are not legal partners or agents of one another.

19. Privacy Policy

At Yenos, we understand that the privacy and confidentiality of your personal information is important to you. This Privacy Policy outlines the types of personal information we collect, how we use this information, and your rights in relation to this information.

We collect personal information from you when you purchase your Yenos test. This information may include your name, mailing address, email address, phone number, and other identifying information. We also collect information about your use of the Yenos test including the date and time of your test, and the results of your test. If you test positive for cancer we will then request demographic data (such as age, gender, ethnicity, and family medical history), and other relevant health information.

We use your personal information to process your order and provide you with the Results Report. Yenos does not sell personal information and sharing only occurs with necessary service providers (FedEx, Stripe, lab). We will not disclose your personal information to any other party without your consent unless we are required to do so by law. We take reasonable steps to protect your personal information from misuse, interference, loss, and unauthorized access, modification, or disclosure. We use a variety of security measures to ensure the confidentiality and integrity of your personal information, including encryption and firewalls. De-identified and aggregated testing data may be used for research and development, if applicable. You have the right to access and correct the personal information we hold about you. You also have the right to request that we delete your personal information, although we may need to retain certain information for legal or regulatory reasons.
